HamCoach AI — Terms of Service

Welcome to HamCoach AI. These Terms of Service ("Terms") are a binding agreement between you and HamCoach AI ("HamCoach," "we," "us," or "our") governing your use of the HamCoach AI website, applications, and related services (collectively, the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account, clicking "I agree" at signup or checkout, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Service.
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. The Service
HamCoach AI is an educational exam-preparation tool for U.S. amateur radio license examinations. We are an independent service and are not affiliated with, endorsed by, or sponsored by the Federal Communications Commission (FCC), the National Conference of Volunteer Examiner Coordinators (NCVEC), the American Radio Relay League (ARRL), or any Volunteer Examiner Coordinator. FCC, NCVEC, ARRL, and other third-party names referenced in the Service are the trademarks of their respective owners; nominative use does not imply endorsement.
We do not administer exams, schedule exam sessions, or file license applications with the FCC. You are responsible for registering and sitting for your exam through an authorized Volunteer Examiner Coordinator.
We may modify, suspend, add, or discontinue any feature of the Service at any time, with or without notice. We will use commercially reasonable efforts to provide advance notice of material changes that adversely affect paying users.
3. Educational purpose; no guarantee of results
The Service — including study materials, adaptive recommendations, practice exams, and AI-generated explanations — is provided for educational and study-support purposes only. We do not guarantee that you will pass any examination. Examination results depend on many factors outside our control.
Question pools are based on the publicly released NCVEC question pools. We make commercially reasonable efforts to keep content current and accurate but do not warrant that the Service is free of errors or omissions. Always verify regulatory and technical specifics against official FCC and NCVEC sources.
4. Eligibility and accounts
Age. The Service is not directed to children under 13, and you may not create an account or use the Service if you are under 13. If you are between 13 and the age of majority in your jurisdiction (typically 18), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the Service.
If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information.
Accounts. You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must promptly notify us of any unauthorized use. You may not share your account or transfer it to anyone else.
We may refuse to create, suspend, or terminate any account at our discretion.
5. Subscriptions, billing, and lifetime access
Paid plans. Paid plans are billed through our payment processor, Stripe, on the cadence shown at checkout (e.g., monthly or annually). Prices are shown in U.S. dollars unless otherwise stated and exclude applicable taxes, which may be added.
Automatic renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price until you cancel. By subscribing, you authorize us and Stripe to charge your payment method on each renewal date. The renewal cadence and price are disclosed at checkout, and we will send a confirmation by email summarizing the renewal terms.
Cancellation. You may cancel your subscription at any time from your account Settings. Cancellation takes effect at the end of the current paid period; your access continues until then. California residents and others entitled to equivalent rights may cancel online at any time without contacting support.
Price changes. We may change subscription prices. For recurring subscribers, we will provide at least 30 days' advance notice of any price increase, by email or through the Service, and you may cancel before the new price takes effect.
Failed payments. If a payment fails, we may suspend access until payment is resolved and may terminate the account if the failure is not cured within a reasonable period.
Refunds. Except where required by applicable law, payments are non-refundable. Consumers in the European Union, United Kingdom, and other jurisdictions with statutory withdrawal rights may have a right to withdraw within 14 days of purchase, unless that right has been validly waived at checkout (for example, where you have requested immediate access to digital content and acknowledged the loss of the withdrawal right).
Lifetime access. Where granted (for example, through a promotional code), "Lifetime Access" means access to the Service for so long as HamCoach AI continues to operate the Service in substantially its current form. It does not guarantee any specific duration, nor any specific feature set, content, or service level. Lifetime Access is tied to your account, is non-transferable, and has no cash value. If we discontinue the Service generally, Lifetime Access ends with it; we are not obligated to provide refunds in that event but may offer migration credit or partial refunds at our discretion.
6. Acceptable use
You agree not to, and not to allow anyone else to:
- • access the Service by automated means (bots, scrapers, crawlers) other than as expressly permitted;
- • copy, scrape, mirror, resell, sublicense, or redistribute any content from the Service;
- • reverse engineer, decompile, or attempt to extract source code, model weights, prompts, or proprietary algorithms;
- • use the Service or its outputs to train, fine-tune, or develop any competing product, model, or service;
- • circumvent, disable, or interfere with rate limits, entitlements, paywalls, authentication, or security features;
- • share, sell, or transfer account credentials, or use a single account for multiple end users;
- • abuse, harass, or impersonate any person, or upload malicious code;
- • use the Service for any unlawful purpose or in violation of applicable export controls or sanctions;
- • misuse AI features, including by attempting to elicit harmful, illegal, or rights-infringing output, or by submitting third-party content you do not have rights to submit.
We may investigate and take action against suspected violations, including content removal, rate limiting, suspension, and termination.
7. AI features
The Service uses artificial intelligence to generate explanations, recommendations, and other content. AI-generated content may be incomplete, inaccurate, biased, or fabricated, and is not an official authority on FCC regulations, exam content, or any other subject. You should not rely on AI output for any regulatory, legal, safety, or operational decisions. Always verify against official sources.
We do not use the content of your AI prompts or generated outputs to train foundation models. See our Privacy Policy for more detail on how AI requests are processed, including which third-party AI providers we use and what data is shared with them.
8. Intellectual property and your content
Our IP. The Service, including its software, design, content, AI prompts, study materials (excluding the underlying public NCVEC question text), and trademarks, is owned by HamCoach AI or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial study purposes.
Your content. If you submit content to the Service (for example, notes, flagged questions, feedback, or AI prompts) ("User Content"), you retain ownership but grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, and use that content as necessary to operate, secure, and improve the Service. You represent that you have the rights necessary to grant this license and that your User Content does not violate any law or third-party right.
9. Third-party services
The Service relies on third-party providers, including Stripe for payments and AI providers for inference. Your use of those features is also subject to the relevant third party's terms and privacy practices. We are not responsible for third-party services, and their availability is outside our control.
10. Termination
By you. You may delete your account at any time from Settings. Deletion ends your access; certain data may be retained as described in our Privacy Policy or as required by law.
By us. We may suspend or terminate your account, with or without notice, if (a) we reasonably believe you have violated these Terms or applicable law, (b) your account creates risk or legal exposure for us or others, or (c) we discontinue the Service. We may also terminate inactive accounts.
Effect of termination. On termination, your right to use the Service ends immediately. If we terminate a paid account for cause based on your violation of these Terms, you forfeit any unused prepaid amounts and any Lifetime Access. If we terminate without cause (for example, because we discontinue the Service), we will refund a pro-rata portion of any prepaid, unused subscription fees.
Survival. Sections 3 (no guarantee), 5 (refunds and outstanding charges), 6 (acceptable use, to the extent applicable), 8 (IP and your content license), 9 (third-party services), 10 (termination), 11 (disclaimers), 12 (limitation of liability), 13 (indemnification), 14 (governing law and disputes), and 16 (general) survive termination.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, and uninterrupted or error-free availability.
We do not warrant that the Service will meet your requirements, that any content (including AI output or question pools) is accurate or current, or that the Service will be secure, uninterrupted, or free of harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, HamCoach AI and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service, whether based on contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Our total cumulative liability for all claims arising out of or related to the Service will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or personal injury or death caused by negligence.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless HamCoach AI and its officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right. We may assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.
14. Governing law and dispute resolution
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing any formal claim, you agree to contact us via our contact page and attempt in good faith to resolve the dispute informally for at least 30 days.
Venue. Subject to any applicable arbitration provision, you and HamCoach AI agree that any unresolved dispute will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and each party consents to the personal jurisdiction of those courts and waives any objection to venue.
Jury trial waiver. To the maximum extent permitted by law, each party waives the right to a trial by jury in any proceeding arising out of or related to these Terms or the Service.
Class action waiver. To the maximum extent permitted by law, disputes must be brought in a party's individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
15. Changes to these Terms
We may update these Terms from time to time. For material changes (for example, changes to fees, dispute resolution, or the scope of data use), we will provide at least 30 days' advance notice by email or through the Service, and the changes will not take effect until after that notice period. For non-material changes (for example, clarifications, contact updates, or typo fixes), we will update the "Last updated" date above.
If you do not agree to a material change, your remedy is to stop using the Service and cancel your subscription before the change takes effect. Your continued use after a change takes effect constitutes acceptance of the updated Terms.
16. General
Entire agreement. These Terms, together with our Privacy Policy and any order or checkout page you accept, are the entire agreement between you and HamCoach AI regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or utility outages, third-party service failures, or governmental action.
Communications. You consent to receive transactional communications from us (account notices, receipts, security alerts) by email. Marketing communications are sent only with your separate opt-in, and you may unsubscribe at any time.
Relationship. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and HamCoach AI.
